Preamble
Placing an order for products presented on the website www.art-garden.fr, via the electronic catalogue designed by NEL SOLUTIONS, implies the buyer’s full and unconditional acceptance of these General Terms and Conditions of Sale.
The acceptance of the order by means of electronic signature, materialised by the validation click, together with the provision of bank details ensuring payment, constitutes acceptance without reservation of these Terms. This electronic signature has the same legal value as a handwritten signature in accordance with the French Civil Code.
Article 1 – Acceptance of the General Terms and Conditions of Sale
These General Terms and Conditions govern the contractual relationship between NEL SOLUTIONS and any customer placing an order on the website www.art-garden.fr.
Placing an order implies full and unconditional acceptance of these Terms. In accordance with Article L.132-1 of the French Consumer Code, NEL SOLUTIONS undertakes not to unilaterally modify these conditions once the order has been accepted.
Specific conditions applicable to certain products or services may supplement these Terms and will be specified on the relevant product page.
Article 2 – Products
Customers are informed of the essential characteristics of the products based on information provided by suppliers. Customers are invited to read usage instructions, safety information, and notices supplied with the products.
Images, videos, diagrams, and illustrations are provided for information purposes only and are not contractually binding.
Product offers and prices are valid for as long as they are displayed online, subject to availability. Adding a product to the cart does not guarantee availability at the time of order confirmation.
Article 3 – Orders
3.1 Account creation
The customer declares to be of legal age and legally capable of contracting. To place an order, the customer must create an account and provide accurate and complete information.
NEL SOLUTIONS cannot be held liable for delivery failure due to incorrect customer information.
3.2 Order process and validation
Orders imply an obligation to pay. Products are offered subject to availability.
Once payment is validated, the customer receives an order confirmation by email. NEL SOLUTIONS reserves the right to cancel any order in the event of non-compliance, error or suspected fraud.
3.3 Excess orders
Customers may return surplus goods within 90 days, provided the products are new and clean. Return shipping costs and a €14.90 incl. VAT handling fee will be deducted from the refund.
Article 4 – Delivery and in-store pickup
4.1 Delivery charges
Delivery costs are indicated in the shopping cart and depend on the total weight and destination of the order. Some promotional items may benefit from free delivery.
4.2 Delivery terms
Deliveries are made to the address provided by the customer. Delivery does not include installation. In case of force majeure, delivery times may be extended.
Large or bulky items require suitable access for heavy vehicles. If access conditions are not compliant, delivery may be cancelled with deduction of delivery and return costs.
4.3 Inspection upon delivery
The customer must inspect goods upon delivery and note any reservations on the delivery slip. Claims must be confirmed to customer service within 14 working days.
4.4 In-store pickup
Orders must be collected within:
- 2 calendar days for plant products
- 8 calendar days for manufactured goods
Failure to collect within the specified timeframe may result in cancellation without refund.
Article 5 – Withdrawal, exchange and refund
5.1 Right of withdrawal
In accordance with Article L221-18 of the French Consumer Code, the customer has 14 days to exercise their right of withdrawal, except for personalised or perishable products.
5.2 Exercise of the right of withdrawal
Withdrawal must be notified in writing before expiry of the 14-day period. Products must not be returned without prior notification.
5.3 Return conditions
Returned products must be complete, unused, clean, and in their original packaging. Return shipping costs are borne by the customer.
5.4 Refunds
Refunds are processed within 14 days using the original payment method, subject to receipt of returned goods.
Article 6 – Prices
Prices are stated inclusive of VAT. Delivery charges are shown separately. Any typographical pricing error will result in order cancellation.
Article 7 – Payment
Payment is due in full at the time of order by credit card, PayPal, or bank transfer.
Instalment payments
Payment in 3 or 4 instalments is available via Oney Bank, subject to eligibility and acceptance.
Article 8 – Disputes – Applicable law
These Terms are governed by French law. Any dispute falls under the jurisdiction of French courts. Customers may also use mediation services (MEDICYS).
Article 9 – Retention of title and transfer of risk
Products remain the property of NEL SOLUTIONS until full payment. Risk transfers upon physical receipt of the goods.
Article 10 – Legal warranties
Products benefit from legal conformity and latent defect warranties in accordance with French law.
Article 11 – Legal information
All site content is the exclusive property of NEL SOLUTIONS. Any unauthorised reproduction is prohibited.
Article 12 – Privacy policy and cookies
Personal data is processed in compliance with GDPR and French data protection laws. Customers may exercise their rights by contacting customer service.
Article 13 – CASANEO platform processing
Art Garden uses the CASANEO platform for affiliate tracking, administration, and promotional integration.
